The owner of a national mark or CTM may be a legal and a physical person domiciled or having registered principal place of business in any country. Protection under Madrid system is allowed for persons originating from countries being members to Madrid Protocol.
Representation by a local attorney is not obligatory for residents of Lithuania or any other EU country. Residents of other countries will have to nominate a national attorney in order to obtain a national registration or CTM and in case of disputes. If the Madrid Protocol mark with a basic registration outside Lithuania does not encounter any obstacles, representation by a local attorney is not required, however in case of a refusal or disputes with third persons an applicant residing outside EC will have to nominate a local attorney. It should be noted that all documents to the national Bureau should be submitted in the Lithuanian language, which may also require assistance of a local representative.
